These terms govern your use of the iOS app "SakuLog" (the "App") provided by freetokyo (the "Developer").
By downloading or using the App you are deemed to have agreed to these terms.
The App is a tool for recording your child's artwork as photographs and organising the status of the physical originals. Any decision to keep or release a physical original is yours alone. The counts, goal comparisons and summaries the App displays are aggregations of what you entered; they do not recommend or instruct any particular decision.
Marking an artwork as "released" in the App does not do anything to the physical original. What happens to it is entirely the result of your own judgement and actions. Released originals generally cannot be recovered, so please confirm that a photograph has been saved and decide carefully.
The core features are free. "Full access" is a one-time in-app purchase (non-consumable), not a subscription. Purchases and refunds are handled by Apple. Purchases can be restored with the same Apple Account.
The App's data is stored only on your device and in your own iCloud. The Developer does not hold it. If data is lost through loss or failure of your device, deletion of the App, or changes to your iCloud settings, the Developer cannot recover it. We recommend exporting a yearly PDF as a keepsake copy of artwork that matters to you.
Reverse engineering the App, using it for unlawful purposes, and infringing the rights of the Developer or third parties are prohibited.
To the extent permitted by law, and except in cases of the Developer's wilful misconduct or gross negligence, the Developer's liability for any damages arising from your use of, or inability to use, the App is limited to the total amount you have paid in respect of the App. Where such a limitation is not permitted by consumer protection law or other mandatory law, the Developer is liable to the extent provided by that law.
The Developer may change the App or discontinue providing it. Because your data resides on your own device and in your own iCloud, discontinuation does not cause the Developer to delete your existing data.
These terms are governed by the laws of Japan. The Tokyo District Court shall have exclusive jurisdiction as the court of first instance for any dispute relating to the App.
