1. Scope
These terms govern your use of the iOS application Kartella Pets ("the app") provided by freetokyo ("we"). By using the app you agree to these terms.
2. What the app is
The app is a tool for you to create and keep records for your own work. It does not provide veterinary advice, diagnosis or treatment recommendations. Consult a veterinary surgeon for decisions about an animal's health.
An agreement recorded and signed in the app is your own note of what you and the owner agreed. The app does not give that agreement legal force. Consult a professional where legal effect matters.
3. Your data
Data created in the app is stored on your device. We do not operate a server and the app does not transmit your data to us. See the privacy policy for details.
Where an exported file is saved or sent is your choice. If you place it in a cloud service, that service's terms apply to it.
4. Backups and passphrases
Keep regular backups against loss, damage, reset, OS updates or deletion of the app.
You control the passphrase for an exported file. We cannot recover it. If it is lost, the contents of that file cannot be recovered.
5. Restrictions
Do not use the app for unlawful purposes, decompile or modify it, or infringe the rights of others.
6. Purchases
Additional features are offered as a one-time in-app purchase. Billing and refunds follow Apple's terms.
7. Limitation of liability
We do not warrant, expressly or by implication, that the app is free of defects in fact or in law. Except in cases of our wilful misconduct or gross negligence, we are not liable for damages arising from your use of the app.
Where that exclusion does not apply, our liability is limited to the amount you paid in relation to the app. Where mandatory consumer protection law does not permit the exclusion or limitation of our liability, that law prevails.
8. Changes
We may change these terms. The revised terms take effect when posted on this page.
9. Governing law
These terms are governed by the laws of Japan. The court having jurisdiction over our location shall have exclusive jurisdiction in the first instance.

Limitation of liability (overriding)
Notwithstanding any other provision of these terms, Except in cases of our willful misconduct or gross negligence, our liability for any damages arising from your use of the app is limited to the amount you paid us for the app. Where such a limitation is not permitted by mandatory law, we are liable to the extent that law provides.
